Respondent, Huber Glass Company, Inc., maintained a checking account with the appellant, the First National Bank of Kenosha.
R. C. Huber, respondent's president, and his wife Bertha, were the only ones authorized to sign checks in respondent's behalf.
Kenneth J. Miller began working in respondent's bookkeeping department in 1959 and became head of that department some time
in 1960. Miller was discharged on April 25, 1963, and committed suicide the next day. It was later discovered that certain
checks, signed "R. C. Huber" and made out to and endorsed by Miller, had been drawn on respondent's account in the appellant
bank since August of 1960. Huber denied actually signing any of the checks. On May 2, 1963, respondent brought suit against appellant to recover $23,875.42, which had been paid on 38 of these checks
returned within the prior year as allowed by sec. 116.28, Stats. 1 Judgment was rendered for respondent, Huber Glass Company,
Inc., and appellant appeals.
